Membership

• Membership of BuySellShare is restricted to New Zealand residents only.
• Members must be 18 years or older.
• Membership is for private non-commercial use only. BuySellShare is not an online marketplace for Businesses or Sole Traders of goods and services.

Acceptance

• All Members must accept BuySellShare’s Terms of Use during registration and must adhere to these for the duration of their membership.
• The date of the most recent updates to BuySellShare’s Terms of Use will be published at the top of our Terms of Use page and it is the Member’s responsibility to ensure they have read the most recent Terms of Use and that they adhere to them.
• BuySellShare reserves the right to decline or terminate any membership at it’s discretion.

Disclaimer

• BuySellShare provide this website as a free service to buyers and sellers and does not provide any guarantees on it’s performance, availability or functionality.
• BuySellShare is in no way liable for any warranties, guarantees or the quality of goods and services listed by Sellers or Advertisers.
• BuySellShare is in no liable for any loss, corruption of leak of personal information.
• BuySellShare is in no way liable for any damages, claims, costs or losses incurred as a result of any transactions realted to the use of the website.

• BuySellShare simply provides a ‘connecting’ service between buyers and sellers. Although every effort will be made to govern and regulate the website, BuySellShare take no responsibility for any material, services, goods, activity, transactions or behaviour that could be considered;

• BuySellShare plays no role in any transaction nor does it take responsibility for any transactions that lead to dispute or incompletion and these are at your own risk, the Buyer, Seller or Advertiser.
• Listings are not validated nor checked prior to publishing and BuySellShare hold no rsponsibility nor liability for any that breach these Terms of Use and these will be removed if discovered.

Member Responsibility

• Members must ensure that they do not upload or publish any material, profile information, descriptions, photos, comments or behave in anyway that could be considered;
  • Illegal;
  • Unethical;
  • Objectionable;
  • Inappropriate;
  • Offensive:
  • Racist;
  • Sexist; or
  • Copyright.
• Members must ensure that they only upload or publish information on the website, including profile information, descriptions, photos, ownership, rights to sell, comments, feedback or blog posts that are;
  • Correct;
  • Accurate;
  • True;
  • A fair representation of condition and quality; and;
  • Not in breach of NZ law.
• Members must not upload or publish information on the website, including profile information, descriptions, photos, ownership, rights to sell, comments, feedback or blog posts that includes;
  • Pornography, adult or mature content;
  • Violent content;
  • Hate speech (including content that incites hatred or promotes violence against individuals or groups based on race or ethnic origin, religion, disability, gender, age, veteran status, or sexual orientation/gender identity), harassment, bullying, or similar content that advocates harm against an individual or group;
  • Profanity;
  • Hacking/cracking content;
  • Malware or adware;
  • Illicit drugs and drug paraphernalia content;
  • Content that promotes, sells, or advertises products obtained from endangered or threatened species;
  • Beer or hard alcohol;
  • Tobacco or tobacco-related products;
  • Prescription drugs;
  • Weapons or ammunition (e.g., firearms, firearm components, fighting knives, stun guns);
  • Distribution of coursework or student essays;
  • Content regarding programs which compensate users for clicking ads or offers, performing searches, surfing websites or reading emails; or
  • Any other content that is illegal, promotes illegal activity or infringes on the legal rights of others.
• Members must act in good faith whether buying or selling items.
• Buyers and Sellers must not promote, advertise or hyperlink to any external parties or websites.
• Where an auction expires and the reserve price has been met, a contract of sale is established solely between the Buyer and the Seller.
• Any dispute arising from a transaction is between the Buyer and the Seller or Advertiser.
• Members are responsible and liable for all of the interactions they have with the website, other members and advertisers.
• Members must use the Feedback function in good faith and prior to posting negative feedback, all attempts should be made to resolve any issues experienced during the transaction.

Seller and Advertiser Responsibilities

• All prices listed must be in New Zealand currency (NZD) and include GST.
• All prices and costs must be accurate and all costs must be disclosed, i.e. no hidden costs.
• Sellers must ensure that for all items they list that;
  • They are legally entitled to sell the item; and
  • They have the goods in their possession; and
  • The items are available for viewing and appraisal if required.
• Sellers and Advertisers must be legally entitled to sell the products and services they are listing or advertising.
• Sellers must ensure they are entitled to publish any images uploaded and that no copyright is breached.
• Seller must have the intention of selling all items listed.
• Items listed elsewhere should state this explcitly in the listing description and once reserve is met, it should be removed from any other forums (online or physical).
• Sellers may withdraw any listings that have not had the reserve price met.
• Shill-bidding (false bidding to stimulate the auction process and raise price) is strictly prohibited.
• Sellers listing Motor Vehicles must ensure they disclose the number plate, warrant of fitess, certificate of fitness and registration status, odometer reading, whether there are security interests and any known defects or mechanical issues.
• Sellers listing firearms must only sell these in compliance with the Arms Act 1983.
• Sellers listing any of the following media types must ensure they are compliant with the Films, Videos and Publications Classification Act 1993 and that Classifications are stated in the Listing description. This includes but may not be limited to DVDs, videos and Laser Discs.

Buyer Responsibility

• The Buyer must act in good faith and only bid or complete purchases with the intention to complete the transaction.
• The Buyer must take no longer than 48 hours to contact the Seller to arrange payment and arrange collection or shipping.
• The Buyer should make payment within 72 hours of winnig the auction of completing a purchase.
• Should the Buyer fail to complete a transaction without a valid reason, their membership may be terminated at the discretion of BuySellShare.

Breach of Terms of Use

Should any Member breach these Terms of Use, BuySellShare may take any or all of the following actions;

• Remove the content or listing that breached the Terms of Use;
• Report the breach if necessary to any authorities including the NZ Police; and
• Suspend or terminate membership.
